OBJECT
This document (hereinafter, simply “Terms and Conditions”) regulates the general terms and conditions of use of the website to which you have just accessed, owned by DANIEL CASTELO BRANDS, UNIPESSOAL LDA., As well as the terms and conditions of purchase and sale of products sold through the respective online store www.housewineexperience.com, hereinafter simply referred to as website and online store.
INTRODUCTORY PROVISIONS
1. Identification of the owner of the website and supplier of the products:
1.1. The owner of the website and supplier of the products sold in the online store is DANIEL CASTELO BRANDS, UNIPESSOAL LDA., Headquartered at Praça do Império, nº 63, 4150 -403 Porto, NIPC 513055320, hereinafter referred to as “HOUSE WINE EXPERIENCE”.

2. Use of the website
2.1. The use of the website, either through simple navigation or through the establishment of a commercial relationship with HOUSE WINE EXPERIENCE through the respective online store, it assigns you the status of User and implies acceptance, fully and without reservations, of all the provisions included in these Terms and Conditions as well as in the Privacy Policy, in force at each time you access the website.
2.2. These Terms and Conditions apply to all Users of the website, including, without limitation, visitors, customers, and others not specifically identified.
2.3. The contractual proposal regarding the purchase and sale of products marketed by HOUSE WINE EXPERIENCE in the online store is addressed only to persons of legal age with full capacity and who, therefore, can be responsible for the commitments resulting from the purchase and sale of products marketed by HOUSE WINE EXPERIENCE.
2.4. If the User does not agree with these Terms and Conditions, in their entirety, he should not access the website or the features and services associated with it.
2.5. The User accepts these Terms and Conditions on his behalf and/or the organization he represents (if applicable).
2.6. When placing orders through our online store, the User declares to be over 18 years old, guaranteeing that he has full legal capacity for the acts he practices and the powers necessary to carry out this acceptance.
2.7. More, by accepting these Terms and Conditions, the User expressly declares that he will not use the website and the features and services associated with its use, for any illegal and/or unlawful purposes.
2.8 HOUSE WINE EXPERIENCE reserves the right to change these Terms and Conditions at any time and without prior notice. The User must consult the Terms and Conditions before each use of the website or online store.
2.9. Without prejudice, any changes to the Terms and Conditions after the confirmation of any order, do not bind the User about such order. The Terms and Conditions in force on the date of confirmation of each order will apply.
2.10. The HOUSE WINE EXPERIENCE guarantees the security of the account within the security measures expected and appropriate for platforms such as the website and respective online store.
2.11. HOUSE WINE EXPERIENCE is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions, or disconnections of the operating system that may temporarily prevent access, navigation, or provision of services to Users.
2.12. Under no circumstances may HOUSE WINE EXPERIENCE and/or its representatives and workers be held responsible for any damages that may arise, even accidentally, from the malfunction of the website, in any capacity and whatever the time malfunction, or any damage caused by reproduction, use or exploitation.
2.13. The user’s violation of the provisions of these Terms and Conditions constitutes a basis for its resolution by HOUSE WINE EXPERIENCE. In any case, the violation of the provisions of these Terms and Conditions by the User and regardless of whether its resolution is operated or not, always give HOUSE WINE EXPERIENCE the right to be compensated for all the resulting losses. Also, HOUSE WINE EXPERIENCE reserves the right, at its discretion, to terminate the use of the website and its functionalities and services by the User in question, with or without notification to it.
3. Client registration on the website
3.1. Mere access to the website is not subject to registration. However, such registration will be necessary to enjoy all the website’s features and services.
3.2. The registration on the website is made through the creation of a User account. For this purpose, you must complete a form in which you must indicate the following data:
Email address;
Name (first and last);
Password.
3.3. Nevertheless, if the User only wishes to purchase at the online store, without registering as a customer, he may register only as a guest – providing only his email address.
3.4. The User is responsible for the veracity, completeness, and legality of the data provided, either at the time of registration or to make purchases at the online store, as well as for the respective update. In these terms, the User will be the sole and exclusively responsible for any false or inaccurate statements that he makes and, consequently, for reimbursing HOUSE WINE EXPERIENCE of all losses resulting from the breach of this provision.
3.5. All the contents inserted in the User’s account, as well as all the activity that takes place therein, are the User’s responsibility, and there is no obligation on the part of HOUSE WINE EXPERIENCE to monitor the contents or (non) fulfillment of any responsibilities. User.
3.6.The HOUSE WINE EXPERIENCE does not have access or knowledge of the password defined by the User to access the website, and the User is responsible for ensuring the confidentiality of the password and guaranteeing its safekeeping and good use, as well as, good practices regarding the security of your account (in particular, changing your password regularly and avoiding connections through networks open to the public). As such, HOUSE WINE EXPERIENCE cannot be held responsible for losses arising from the loss or misuse of the User’s password.
PRODUCTS
4. Product Features
4.1. The website offers a wide range of products for purchase through the online store.
4.2. All of these products are illustrated with photographs and an indication of their essential characteristics and are available, without distinction, for purchase by Consumers or Professionals.
4.3. HOUSE WINE EXPERIENCE has made every effort to ensure that the information presented on the website and in the respective online store is free of typographical errors and, whenever these occur, HOUSE WINE EXPERIENCE will proceed with the respective correction as soon as possible. Likewise, HOUSE WINE EXPERIENCE will use its best efforts to keep the product information contained on the website and in its online store up to date.
4.4. At any time HOUSE WINE EXPERIENCE may change, delete or move any information on the website and in the respective online store, without prior notice, namely those relating to products, prices, promotions, offers, commercial conditions, and services.
4.5. The User expressly accepts and conforms, expressly, to the following:
a) The photographs presented on the website are for illustrative purposes only, and the User must read and fully read the information on the essential characteristics of the products found described on the website, and in case of doubt, contact HOUSE WINE EXPERIENCE to obtain additional information;
b) Detailed information about the products and their characteristics/specifications can be consulted at HOUSE WINE EXPERIENCE;
c) All products for sale on the website are subject to existing stock;
d) The prices and products available on the website are only valid for commercial transactions carried out through the online store.
4.6. The information made available on the HOUSE WINE EXPERIENCE website and in the respective online store regarding products intended for human consumption, does not exempt the consultation of the label of these products when they are received by the User and before the respective consumption, and the User should always read the information on ingredients, recommendations for use and/or conservation, warnings, as well as all mandatory and/or voluntary information on the Product before using or consuming it, HOUSE WINE EXPERIENCE is not responsible for any consequences resulting from non-consultation information on the labels.
5. Total price of products
5.1.The price of each product sold by HOUSE WINE EXPERIENCE is duly indicated on the website, in Euros, including VAT at the legal rate in force.
5.2.The price of the products does not include transport/delivery costs to the User. You should consult the Delivery Conditions, in the following clause.
5.3.The costs of transporting the products and, if applicable, the products exempt from transport costs, will be presented to the User at the moment immediately before the Order Confirmation by the User.
5.4.The price of products is subject to change by HOUSE WINE EXPERIENCE, without prior notice, until the moment of the Order Confirmation by the User.
6. Purchasing and selling products – processing and negotiating conditions
6.1.1. For the purposes of finalizing the order, the User must enter the requested personal data, including the delivery/billing address. If you have registered as a customer, the aforementioned data will only be requested when the first purchase is made through the website and will be saved for future purchases. This way, they will not be asked again, and the User should only log in to the website in the future.
6.1.2. The User will then be informed of the applicable/available Delivery Conditions:
Delivery by carrier (MRW). Delivery times: 3 working days in mainland Portugal; 5 to 9 working days in Madeira and Azores Islands; 4 working days in Peninsular Spain. Delivery costs: € 6.00. If the user wishes to place an order for another location, he must first contact HOUSE WINE EXPERIENCE.
6.1.3. After the dispatch of orders, the information for monitoring the shipment will be available in the account of customers who have placed the order with registration and a notification is also sent via e-mail with the delivery information. If for any reason the customer does not receive the shipping confirmation, he should contact HOUSE WINE EXPERIENCE.
6.1.4. Then the User must choose the payment method, having the following options available:
Paypal;
Credit Card (Visa, Mastercard);
6.1.5. Before Confirming the Order, the User undertakes to verify the data contained in his order summary, confirming the User data, the products selected in the shopping cart, the respective mode of delivery and payment method, having to go back to the steps previous to proceed with the respective rectification in case it detects any non-conformity.
6.1.6. Before finalizing the order, the User must read the “Terms and Conditions”, inserting the agreement symbol in the available box, just in case he accepts them. Acceptance of the “Terms and Conditions” is an absolute requirement for the continuation of the operation. The User must immediately print and file the Terms and Conditions for future reference.
6.2. Confirmation of the order and contract formation – step 3
6.2.1. After completion of the previous steps and with the reading and confirmation of acceptance of these Terms and Conditions and the Privacy Notice, the User will be able to confirm the Order.
6.2.2. Upon confirming the order, the User enters into a purchase and sale agreement with HOUSE WINE EXPERIENCE, expressing his complete acceptance of the description of the products included in the transaction, the respective prices, and these Terms and Conditions, which contain the only applicable provisions between User and HOUSE WINE EXPERIENCE.
6.2.3. After Order Confirmation by the User, the user will receive an email confirming that his order has been received by HOUSE WINE EXPERIENCE (Order Confirmation email). This email will contain a summary of the information about the order placed, including the name/reference of the product, the total price of the same, chosen shipping option and associated shipping costs, as well as the payment method selected by the User and the respective deadline ( if you have not opted for automatic payment via Credit Card, for example). If any data is not correct, the User must immediately request a change from HOUSE WINE EXPERIENCE.
6.2.4. Notwithstanding the provisions of the preceding paragraphs, all orders in HOUSE WINE EXPERIENCE will only be processed after the actual receipt of payment. Order formalization alone does not constitute a product reservation.
6.2.5. After receipt of payment for the total price of the products, the invoice will be issued and sent to the email provided by the User. Once issued, the invoice cannot be reissued with changes.
6.2.6. With the Order Confirmation by the User, accompanied by the subsequent full payment of the price of the products, the contract for the purchase and sale of the products made available on the online store by HOUSE WINE EXPERIENCE is formalized, however, its effectiveness, however, dependent on the availability of products in stock, in accordance with the provisions of the following numbers.
6.2.7. All orders for products in the online store will be subject to availability in stock. HOUSE WINE EXPERIENCE is not obliged to supply products that are unavailable. If the ordered products are not available in stock, HOUSE WINE EXPERIENCE will inform the User immediately after becoming aware of this unavailability and will act in accordance with the provisions of the following numbers.
6.2.8. If there is temporary unavailability of any of the products in stock, making it impossible to deliver them within the agreed deadlines, HOUSE WINE EXPERIENCE will contact the User seeking to agree with him in one of the following options: (i) fix a new delivery time; (i) the supply of a product of equivalent quality and price, if any; or (iii) the cancellation of the order in relation to the missing products, in which case HOUSE WINE EXPERIENCE will refund the amounts paid by the User, within a maximum period of 30 (thirty) days after the notification of the cancellation.
7. Delivery of products and respective terms
7.1. The purchase and sale contract has been formalized, full payment of the total price of the products has been made, and provided that the purchased products are available, all under the terms set out in the previous clauses, HOUSE WINE EXPERIENCE will send the User the product shipping information, in accordance with the provisions of clause 6.1.3.
7.2. Notwithstanding the foreseen deadlines, delays may occur for any of the following reasons, which are not attributable to HOUSE WINE EXPERIENCE, and which therefore will not give the User any right to compensation:
a) Delays by the carrier;
b) Difficulties in delivery to the recipient;
c) Local holidays.
7.3. The User must ensure the presence of someone at the delivery address of the products, on the date indicated by HOUSE WINE EXPERIENCE.
7.4. In the event of an unsuccessful delivery attempt by the carrier due to absence, and depending on the service and the carrier, orders must be collected at the location indicated by the same in the passage notice, or the indications requested in the same notice must be followed.
7.5. HOUSE WINE EXPERIENCE refuses any responsibility for any delay or impossibility of delivering the order, resulting from acts for which it is not responsible.
7.6. HOUSE WINE EXPERIENCE is not responsible for shipments made to countries where the respective law does not allow the entry of alcoholic beverages. It is the customers’ responsibility to seize the respective orders, as well as to pay customs fees if any. In case of return of products, HOUSE WINE EXPERIENCE will refund only the amount related to these same products. In case of doubts, the customer can contact HOUSE WINE EXPERIENCE before ordering.
7.7. The deadline for delivery of the ordered products is 30 days, counting from the day following the confirmation of payment of the total price of the products.
7.8. For these Terms and Conditions, a “delivery” is considered to be made or a product is considered “delivered” with the signature of the delivery receipt at the agreed address, or, when the product is picked up at the store, with the signature of the withdrawal receipt.
7.9. HOUSE WINE EXPERIENCE does not exchange. As such, in case of a mistake by the User, the user must return the product applying, for the purpose, the provisions of the Right of Resolution clause, and then place a new order, with the products he wants.
PRODUCT WARRANTY
8. Product compliance guarantee
8.1. The HOUSE WINE EXPERIENCE is responsible for any lack of conformity of the products that exist at the time they are delivered to the User.
8.2. The products do not comply with the purchase and sale contract when any of the following facts are verified:
a) When the products do not comply with the description made by HOUSE WINE EXPERIENCE on its website or do not have the qualities that HOUSE WINE EXPERIENCE has presented the User as a sample or model;
b) When the products are not suitable for the specific use for which the User destines them and of which he informed HOUSE WINE EXPERIENCE when he signed the contract and which he accepted;
c) When the products are not suitable for the uses usually given to goods of the same type;
d) When the products do not present the usual qualities and performance in goods of the same type and which the User can reasonably expect, given the nature of the good and, eventually, the public statements about its specific characteristics, made by HOUSE WINE EXPERIENCE or by the brand, namely in advertising or labeling.
8.3. Under the terms of Consumer Law, the general warranty period for products is 2 (two) years for new products, from the date of delivery of the products to the User, provided that the product defect is reported to HOUSE WINE EXPERIENCE within a maximum period of 2 months from the date it was detected. In sales to professionals, HOUSE WINE EXPERIENCE is also responsible for any defect in the products that exist at the time they are delivered to the User, with a warranty period of 6 (six) months, from the date of delivery of the products to the User.
8.4. Notwithstanding the provisions of the preceding paragraphs, whenever perishable products are concerned, their conformity will only be expected during the respective validity period.
8.5. Except for the provisions of the previous numbers, cases in which the products sold are sealed and not susceptible to return for reasons of health or hygiene protection, when opened after delivery. In these situations, the right to freely terminate the contract is not applicable, and HOUSE WINE EXPERIENCE reserves the right to refuse to return open products after delivery.
9. Exclusions of warranty
9.1. There is no lack of conformity or defects in the products, within the meaning of the applicable law, if, at the time the contract is concluded, the User becomes aware of this lack of conformity or the defects or cannot reasonably ignore them.
9.2. HOUSE WINE EXPERIENCE is not responsible for the lack of conformity or defects in the products, the occurrence of vices or defects for which HOUSE WINE EXPERIENCE is not responsible, namely when they arise from the following situations:
a) failure to use and/or preserve the products in a careful, diligent and/or under the respective indications;
b) The use of products for a purpose other than that for which they are intended;
c) The production of products according to the customer’s requests and specific characteristics as indicated;
d) The normal use/consumption of products;
e) Due to the expected shelf life of the product;
f) Product modification or alteration.
10. Procedure
10.1. If the purchased Product is not in conformity or suffers from a defect, the User must communicate the situation to HOUSE WINE EXPERIENCE, presenting the respective invoice and the description of the non-conformity, and the respective products must be delivered to HOUSE WINE EXPERIENCE for evaluation.
10.2. After receipt of the products, a check will be made for the reported non-conformity and, in case of any non-conformity under the responsibility of HOUSE WINE EXPERIENCE, the User will have the possibility to choose between one of the following options ( legal possibility of repair, as incompatible with the products sold by HOUSE WINE EXPERIENCE):
a) Replacement of the product with another with identical characteristics;
b) Reduction in the price paid for the products;
c) Termination of the Contract, under the terms of the following Clause.
10.3. The costs of returning or collecting products under warranty will be borne by HOUSE WINE EXPERIENCE whenever it is concluded that the non-conformity in question is under the warranty period.
TERMINATION OF THE CONTRACT
11. Right of free termination of the contract
11.1. The provisions of this clause apply exclusively to sales made to final consumers, as defined in Law No. 24/96, of July 31, with the changes subsequent
11.2. The User has the right to freely terminate this contract within 14 calendar days, without the need to indicate any reason. The period for exercising the right of withdrawal expires within 14 days from:
a) From the day on which the User or a third-party indicated by the User (except for the carrier), acquires physical possession of the product; or
b) From the day on which the User or a third party, except for the carrier, indicated by the User, acquires physical possession of the last product, in the case of several goods ordered by the User in a single order and delivered separately.
11.3. The right of free withdrawal may be exercised by the User for all products purchased or only for some of the products included in order.
11.4. For this purpose, the User must fill in the “Free resolution” model suggested below, or direct a written and unequivocal communication of his decision to resolve, and may do so by email to the HOUSE WINE EXPERIENCE email address, info@housewineexperience.com. HOUSE WINE EXPERIENCE will send the User, by email, an acknowledgment of receipt of the request for resolution, within 24 hours.
11.5. For the resolution period to be respected, it is enough that the communication regarding the exercise of the free right of resolution is sent before the end of the resolution period provided for in paragraph 2 of this Clause.
11.6. Except for the provisions of the previous paragraphs, cases in which the products sold are sealed and not susceptible to return for reasons of health or hygiene protection when opened after delivery. In these situations, the right to freely terminate the contract is not applicable, and HOUSE WINE EXPERIENCE reserves the right to refuse to return open products after delivery.
12. Obligations of the parties resulting from the free termination of the contract
12.1. When the products have already been delivered to the User, the User must, within 14 days from the date on which he communicated his decision to terminate the contract to HOUSE WINE EXPERIENCE, return or deliver the products to HOUSE WINE EXPERIENCE, incumbent upon you to bear the costs of returning the products.
12.2. In the event of termination of this contract before the order is received by the User, all payments made by the User will be refunded, including any costs for delivery of the products (except when the User has requested a more onerous delivery method than the most commonly accepted).
12.3. HOUSE WINE EXPERIENCE reserves the right to withhold the refund of the amounts paid by the User until the products are returned to him.
12.4. The refund will be made using the same payment method used in the initial transaction unless the User expressly agrees otherwise. 12.5. The User must keep the products to be able to return them in the proper conditions, in their complete original packaging, and always accompanied by the respective box receipt or original invoice.
12.6. The contractual right to return products applies exclusively to products that can be returned under the same conditions in which the User received them. To return the order, the product must be in perfect condition, and if applicable with its original packaging, accessories, or promotional offers included, and accompanied by proof of purchase or invoice. Any product that has been damaged or that shows signs of use beyond simply opening its outer packaging, namely because the respective labels have been removed/cut or any security seals have been breached, HOUSE WINE EXPERIENCE may reject the refund.
12.7. The User cannot terminate the contract when the traded product has been, in any of its components, made according to the User’s specifications or customized.
12.8. If the above conditions are not met, the return will be rejected, and an email will be sent to the User indicating the respective reasons. The User will, in this case, have the option to request the reshipment of products not accepted for return, with reshipment charges being supported.
FINAL PROVISIONS
13. Intellectual property
13.1. HOUSE WINE EXPERIENCE is the owner of all intellectual property rights on the website.
13.2. The contents that are made available by HOUSE WINE EXPERIENCE through the website, namely, texts, images, brands, logos, source codes, are protected by intellectual property legislation, namely by copyright and industrial property rights, its ownership or license being held by HOUSE WINE EXPERIENCE and its suppliers or licensors and may not be copied, imitated or used, in whole or in part, without the prior written authorization of HOUSE WINE EXPERIENCE or the right holder. applicable intellectual property, which the User recognizes and accepts.
13.3. The User undertakes not to make any abusive use of these same contents, which cannot be copied, disseminated, used, or copied in any way, not using software tools to collect protected content, namely robots, crawlers or other automatic mechanisms.
13.4. The User will not copy, translate, disassemble or decompile, nor create or attempt to create, by reverse engineering or otherwise, the source code and the object code of the website and respective online store, as well as third-party tools and applications and software associated with its operation, nor will it remove any confidentiality or intellectual property notices.
13.5. The User undertakes to fully reimburse HOUSE WINE EXPERIENCE for any indemnities, costs, or expenses it supports as a result of claims of any kind or nature that are directed against it by third parties, based on the violation of the rights of third parties, namely intellectual property rights related to the use of content made available, provided or made available through the website and the services associated with it, including for indemnities paid to third parties under these.
14. Protection of Personal Data
HOUSE WINE EXPERIENCE, while responsible for the treatment, respects your privacy. All personal data collected on the website will be kept confidential and will not be sold, communicated, or, in any way, reused by third parties without your authorization. Any personal data provided to us will be treated under the relevant legislation, with best practices and ensuring all technical and organizational security measures to protect them, these being used for the sole purpose of executing your purchase order and improve your experience on our website. For more information on how we treat your data, you should consult our Privacy and Cookie Policy, without prejudice to the notices contained in the appropriate places.
15. Responsibility
To the maximum extent permitted by law, HOUSE WINE EXPERIENCE will only be liable for damages caused by gross negligence or fraud. HOUSE WINE EXPERIENCE does not assume any responsibility for the continuous availability of its website, especially mobile networks, the Internet, and mobile devices.
16. User support and complaints
The The User can comment, suggest, or complain to HOUSE WINE EXPERIENCE by telephone, to the number +351 910 061 299 (available from Monday to Friday from 9 am to 1 pm and from 2 pm to 6 pm) or through email contact info@housewineexperience.com.
17. Alternative dispute resolution
17.1. The provisions of this clause apply exclusively to sales made to final consumers, as defined in Law No. 24/96, of July 31, with subsequent changes.
17.2. HOUSE WINE EXPERIENCE informs that, under the terms of the Consumer Protection Law, consumption conflicts of low economic value (less than € 5,000.00) are subject to necessary arbitration or mediation, whenever, at the express option of the consumers, they are submitted to the arbitral tribunal assigned to legally authorized consumer dispute arbitration centers. Thus, in the event of a dispute, the final consumer may resort to any of these means and must be represented by a lawyer or solicitor (or request legal aid, as provided by law).
17.3. More, under Reg. (EU) 524/2013 of the European Parliament and the Council, the User can access at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main .home.chooseLanguage to the Online Dispute Resolution Platform (RLL), where information is available on the possibility of using it to resolve your disputes.
17.4. Also on the Consumer Portal (www.consumidor.pt) information is available on the Alternative Dispute Resolution Entities available to promote the extrajudicial resolution of national and cross-border disputes under Law No. 144/2015, of September 8, with the subsequent changes, when they are initiated by a consumer against a supplier of goods or service provider and respect the contractual obligations resulting from purchase and sale contracts or the provision of services, concluded between the supplier of goods and services. Established goods or service provider and consumers resident in Portugal and the European Union.
17.5. Under the terms and for the provisions of art. 18 of Law No. 144/2015, of 8 September, it is hereby informed that the available ADR entity is the Center for Arbitration of Consumer Conflicts in Lisbon, with the following contacts:

17.6. Notwithstanding the provisions of the preceding paragraphs, any disputes submitted to judicial review must be submitted to the appreciation of the Portuguese Courts.
THE USER DECLARES TO HAVE READ AND UNDERSTOOD THE PRESENT GENERAL CONDITIONS, AS WELL AS THE POLICIES THAT ARE ASSOCIATED WITH THEM, AND THAT HAD THE OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE, BEFORE ACCEPTING THEM.
